Disciplinary complaint against solicitor’s office dismissed

scarlettThe Commission of Lawyer Conduct and the Office of Disciplinary Counsel have dismissed  complaints filed against Solicitor Scarlett Wilson by both a Columbia attorney, Desa Ballard, and Myrtle Beach attorney, Bobby Frederick.

According to Solicitor Scarlett Wilson the dismissal does not come as a surprise because she says her staff has never once behaved unethically.

“We have a great group of prosecutors who understand our mission: seeking justice through vigorous enforcement of the law in a reasonable, honest and efficient manner,” stated Wilson.

In February, Bobby Frederick, president of the South Carolina Association of Criminal Defense Lawyers, sent a letter to the attorney general accused Wilson’s prosecutors of not sharing evidence with defense lawyers, tampering with witnesses and other questionable acts.

“Several things are important to remember about the claims. Most of them stem from cases that were handled long ago in circuit court,” explained Wilson. “Most did not directly involve me. None of the judges who actually knew and experienced these cases—the judges who actually lived and presided over them– has ever made a finding of prosecutorial misconduct.”

In March, South Carolina Attorney General Alan Wilson stated that he would not pursue an investigation into Wilson’s office.

“All of the claims were meritless and I appreciate the Commission’s and the ODC’s investigation, review and resulting affirmation. Finally, I am grateful for the outpouring of support from friends, colleagues and constituents who saw this attack for what it was: a political smear,” stated Wilson.

The dismissals come after an independent investigation by the Office of Disciplinary Counsel and the Commission on Lawyer Conduct which consists of 50 members (34 South Carolina attorneys and 16 members of the general public).
