BERKELEY COUNTY, S.C.—According to Mark Powell, spokesperson for the state’s attorney general, a Berkeley County grand jury has indicted Amy Kovach, the school district’s communications director, on a second charge of forgery.
According to the indictment, Kovach created a false, backdated invoice, purporting to be from the Berkeley Co. School District to the “Yes 4 Schools” campaign, in an attempt to establish that she had intended to have public funds repaid to the county which had been spent on materials in support of a bond referendum election campaign. The invoice was for less than $10,000.
The Post and Courier recently spoke to Kovach’s lawyer, Jerry Theos, who said he was “shocked” by the additional charge.
“The Attorney General’s office didn’t advise me in advance that they were seeking an indictment. They have not provided me with notice that they’ve submitted one to the grand jury and haven’t provided me with a copy of the indictment,” Theos told the paper. “I have no idea what it would be based upon, but there is no evidence whatsoever to support the charge.”
In February of this year, Kovach was indicted on one count of violating the ethics act by allegedly abusing public funds to influence the outcome of an election.
Superintendent Rodney Thompson and Deputy Superintendent Archie Franchini were previous targets of an in depth investigation regarding the “Yes 4 Schools” campaign as well.
According to Powell, the SLED investigation remains ongoing.
Kovach began working for the Berkeley Co. School District in 2011 after spending several years working for MeadWestvaco in their communications department. In May, the school board voted to continue paying for Kovach’s legal fees.
